General Terms and Conditions – Callas Confiture Webshop

1. Identification of the Seller

Hereinafter referred to as: “Callas Confiture”, “we” or “us”.
These general terms and conditions apply to all purchases made by consumers through our webshop.
2. Order and Conclusion of the Agreement
By placing an order through our webshop, the consumer makes an offer to purchase the selected products.
The agreement is concluded as soon as Callas Confiture electronically confirms the order.
After placing the order, the consumer will receive an order confirmation by e-mail containing an overview of the products ordered, prices, delivery costs and payment details.
Callas Confiture reserves the right to refuse an order where there are legitimate grounds for doing so, for example if a product is unavailable or if obvious errors in the price or product information have been identified.
3. Product Information and Prices
We make every effort to display our products, ingredients, weights, images and other product information as completely and accurately as possible.
Minor colour differences between a product image and the product actually delivered may occur.
All prices stated on the webshop include VAT, unless expressly stated otherwise.
Any delivery costs are shown separately before the order is definitively placed.
The price applicable at the time the order is placed applies to that order.
4. Payment
Payment is made using the payment methods offered on the webshop.
The order will be processed once payment has been successfully received, unless expressly agreed otherwise.
If a payment cannot be completed, the order will not be processed until payment has been correctly received.
5. Delivery
We make every effort to process and deliver orders as quickly as possible.
The expected delivery period is stated during the ordering process. Stated delivery periods are indicative, unless expressly agreed otherwise.
If an order cannot be delivered within the agreed delivery period, Callas Confiture will, where necessary, contact the consumer.
The risk of loss or damage to the goods passes to the consumer when the consumer, or a third party designated by the consumer other than the carrier, physically takes possession of the goods.
If the consumer has selected a carrier that was not offered by Callas Confiture, the risk passes to the consumer as soon as the goods are handed over to that carrier.
6. Inspection upon Receipt and Complaints
The consumer is requested to check the order as soon as possible after receipt.
In the event of an incorrectly delivered, damaged or defective product, we ask the consumer to contact us as soon as possible via info@callasconfiture.com, preferably stating the order number and providing photographs of the issue.
Submitting a complaint does not mean that the consumer waives any statutory rights.
7. Statutory Guarantee and Conformity
As a consumer, you benefit from the statutory protection applicable to goods that do not conform to the agreement.
If a product is defective or does not meet what could reasonably be expected, we ask you to contact us so that we can work together towards an appropriate solution.
The statutory guarantee does not affect any additional commercial guarantees offered by Callas Confiture.
8. Right of Withdrawal
For online purchases, consumers generally have a statutory right of withdrawal of 14 calendar days. This period starts on the day on which the consumer, or a third party designated by the consumer, receives the goods.
Exception for Our Food Products
The right of withdrawal does not apply to products that are liable to deteriorate or expire rapidly, or whose shelf life is otherwise limited. This includes, among other things, food products for which the law provides for this exception.
For products to which the right of withdrawal does apply, the consumer may notify us within the statutory period of 14 calendar days that they wish to withdraw from the purchase.
The consumer may do so by contacting us via info@callasconfiture.com, stating the order number and the products concerned.
Products for which no statutory exception applies must be returned in their original condition and, insofar as reasonably possible, in their original packaging.
9. Refunds
When a consumer validly exercises their right of withdrawal, Callas Confiture will refund the amounts due in accordance with the applicable statutory provisions.
The refund will be made using the same means of payment as used for the original transaction, unless the consumer expressly agrees to a different method.
The statutory rules regarding the timing and conditions of refunds shall apply.
10. Cancellation of an Order
An order may only be cancelled as long as it has not yet been processed or shipped, insofar as this is practically possible.
The consumer may contact us as soon as possible via info@callasconfiture.com, stating the order number.
For food products for which the right of withdrawal is legally excluded, an order that has already been processed or shipped cannot be unilaterally cancelled on the basis of the right of withdrawal.
11. Late Payment
If a consumer fails to make a payment on time, the statutory provisions of Book XIX of the Belgian Code of Economic Law shall apply.
No costs will be charged for a first payment reminder. From the date of this first reminder, the consumer will be granted at least 14 calendar days to pay the outstanding amount. No additional interest or compensation may be charged during this period.
After this period has expired, and provided that the applicable conditions are met, late-payment interest and a fixed compensation may be charged within the statutory limits.
The fixed compensation is legally limited to:
- a maximum of €20 for an amount due up to and including €150;
- a maximum of €30 + 10% of the amount due above €150, where the amount due is between €150.01 and €500;
- a maximum of €65 + 5% of the amount due above €500, with an absolute maximum of €2,000.
Late-payment interest is calculated on the outstanding amount and may not exceed the maximum interest rate permitted by law.
12. Force Majeure
Callas Confiture shall not be liable for delays or non-performance of an order where this is the result of circumstances beyond our reasonable control.
Such circumstances include, among other things, exceptional production problems, transport problems, strikes, government measures, natural disasters, fire, war and other situations that could reasonably not have been prevented.
If an order cannot be fulfilled due to such circumstances, we will inform the consumer as soon as reasonably possible.
13. Liability
Nothing in these general terms and conditions limits the statutory rights of the consumer.
Callas Confiture cannot be held liable for damage resulting from the use of our products in a manner that is inconsistent with the product information, labelling or instructions for use.
Our liability shall under no circumstances be limited to the extent that such limitation is not permitted by law.
14. Intellectual Property
All texts, photographs, logos, graphic elements, product names and other content on this webshop are the property of Callas Confiture or are used with the permission of the rights holder.
Such content may not be copied, distributed or used commercially without prior written permission.
15. Personal Data
Personal data is processed in accordance with our privacy policy.
The privacy policy describes, among other things, which personal data we collect, the purposes for which it is used, how long it is retained and which rights the consumer has.
16. Cookies
For information regarding the use of cookies, please refer to our cookie policy.
17. Complaints and Disputes
Do you have a question, problem or complaint regarding an order? Please contact us directly first via [e-mailadres]. We will endeavour to resolve every issue as quickly and appropriately as possible.
This agreement is governed by Belgian law, without prejudice to the mandatory statutory protection afforded to consumers.
For disputes with consumers, the courts having jurisdiction under the applicable statutory rules shall have jurisdiction.
18. Amendments to the General Terms and Conditions
Callas Confiture may amend these general terms and conditions where necessary, for example as a result of changes in legislation or in our services.
An order is always subject to the general terms and conditions that were applicable at the time the order was placed.
19. Severability
If any provision of these general terms and conditions is found to be wholly or partially invalid or unenforceable, the remaining provisions shall remain in full force and effect.
The invalid or unenforceable provision shall, insofar as possible, be replaced by a valid provision that most closely reflects its original purpose.
